Frequently recorded questions
The answers below are general information; your specific matter requires a consultation.
Is an oral contract valid?
Unless the law prescribes a particular form, contracts are not bound to any form (Article 12 of the Turkish Code of Obligations, TBK); a written contract nonetheless matters as evidence. Some contracts, such as the sale of real property, require an official form.
When does a contractual claim become time-barred?
Unless the law provides otherwise, the general limitation period is ten years (TBK Article 146); a five-year period applies to certain claims, such as those arising from leases and mandates (TBK Article 147).
What can be done if the other party does not perform?
Once the debtor is in default, the creditor may demand performance together with damages for delay or, under TBK Article 125, waive performance and claim damages or withdraw from the contract; these options are subject to certain conditions.
